Terms and Conditions for The Construction Bible
These Terms and Conditions ("Terms") govern the relationship between The Construction Bible ("the Company," "we," "us," or "our") and the users ("Members," "you," or "your") of our platform. By registering an account or using our services, you agree to be bound by these Terms.
1. The Service
The Construction Bible provides a digital directory and database connecting construction workers, subcontractors, and service providers with contractors and companies in the commercial sector. We are a listing platform only; we do not act as an agency or employer.
2. Membership Tiers
2.1 Free Membership
- Allows workers and companies to list their professional information on the platform.
- Visibility is restricted to a 20-mile radius of the member’s registered address.
2.2 Premium Membership
- Provides UK-wide visibility.
- Includes additional features such as the "Available Now" status icon and prominent placement in search results.
- Subject to a fixed-term contract as defined in Section 3.
3. Subscription and Payment Terms
3.1 Contract Length
Premium memberships are entered into for a fixed term of either twelve (12) or twenty-four (24) months, as selected at the time of signup.
3.2 Monthly Payments
Payments are collected monthly via our designated payment processor. Payments will typically be processed on or around the 1st day of each calendar month.
3.3 Arrears and Missed Payments
In the event of a failed payment, the Company reserves the right to:
- Suspend access to Premium features and UK-wide visibility.
- Pursue the outstanding balance ("chase" the debt) through internal processes or third-party debt collection agencies.
- Charge reasonable administrative fees for the recovery of overdue funds.
3.4 Price Increases
The Construction Bible reserves the right to increase subscription fees from time to time. For active fixed-term Premium Membership contracts of twelve (12) or twenty-four (24) months, any price increase will only apply on renewal of the contract and will not affect the fees payable during the current fixed term. We will provide members with at least thirty (30) days’ notice of any price changes. Any increases will be applied in line with applicable legal guidelines.
4. User Obligations and Accuracy of Information
4.1 Truthful Representation
All members must ensure that the information, qualifications, and certifications uploaded to their profile are true, accurate, and up to date.
4.2 Intellectual Property and Media
By uploading photographs of construction work, you warrant that:
- The work displayed is your own or the work of your company.
- You own the copyright or have the express permission/right to share these images.
- The images do not infringe upon the privacy or intellectual property rights of any third party.
5. Direct Engagement and Limitation of Liability
5.1 Direct Interaction
The Construction Bible facilitates introductions only. Any engagement, contract, or agreement for work is made directly between the searching company and the worker or service provider.
5.2 No Liability for Work or Services
The Construction Bible is not responsible or liable for:
- The quality, safety, or legality of the work completed by workers found on the platform.
- The performance or reliability of site services (including but not limited to skip hire, insurance brokers, tool hire, and material suppliers).
- Any financial loss, property damage, or personal injury arising from a connection made through the platform.
5.3 Payments Between Members Only
The Construction Bible is not responsible or liable for any payments owed to workers, subcontractors, suppliers, or other service providers for work or services secured through the platform. All pricing, invoices, payment terms, and payment disputes are strictly between the worker/provider and the client.
6. User Verification & Use-at-Your-Own-Risk Disclaimer
6.1 Listing Platform Only
The Construction Bible is a listing platform only. We provide a directory and search tools to help members find and contact each other directly. We are not an employment business, agency, broker, contractor, sub-contractor, or party to any agreement entered into between members.
6.2 No Vetting or Verification
We do not vet members and we do not:
- guarantee any member’s qualifications, training, experience, licences or certifications;
- verify insurance policies or insurance coverage (including employer’s liability, public liability, professional indemnity, or any other cover);
- conduct background checks, DBS checks, credit checks, or identity checks; or
- confirm immigration status or UK right to work.
6.3 Your Due Diligence Responsibilities
You are responsible for carrying out your own checks before hiring, engaging, supplying to, or accepting work from another member. This includes (where relevant):
- checking qualifications, cards and certifications (e.g. CSCS or trade qualifications);
- checking insurance is in place and appropriate for the work; and
- confirming UK right to work status and compliance with applicable employment/immigration laws.
6.4 Accuracy of Member Information
We are not responsible for, and do not guarantee, the accuracy, completeness, or up-to-date status of any information provided by members (including profile text, qualifications, availability, pricing, photos, reviews, or contact details). Any reliance on member information is at your own risk.
7. Data Protection and UK GDPR Compliance
7.1 Consent to Process and Share Data
By signing up to The Construction Bible, you provide your explicit consent for us to process and share your personal data, including your name, email address, phone number, and professional qualifications, with other users of the platform for the purpose of facilitating professional engagements.
7.2 Data Usage
Your data will be handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We use your data to:
- Create and maintain your public or semi-public profile.
- Enable search functionality for contractors.
- Communicate service updates and billing information.
7.3 Marketing and Opt-Out
While your professional data is essential for the directory service, you may manage your preferences regarding additional marketing communications through your account settings.
8. Prohibited Use
You must not use (or attempt to use) the platform in any way that is unlawful, harmful, abusive, misleading, or interferes with the platform or other members. This includes (without limitation):
- sending spam, unsolicited messages, or bulk communications (including repeated contact that a recipient has asked you to stop);
- scraping, crawling, harvesting, reverse engineering, or using any automated means to access the platform, profiles, or data without our express written consent;
- using the platform to harass, threaten, defame, discriminate against, or abuse any person;
- posting or transmitting viruses, malware, or any content designed to disrupt, damage, or gain unauthorised access to any system or data;
- attempting to bypass or interfere with security features, access controls, or rate limits; or
- using another member’s personal data in breach of applicable data protection laws.
9. Termination
9.1 Termination by the Member
For Premium Memberships, cancellation before the end of the 12 or 24-month term is not permitted, and the full balance of the contract remains payable unless otherwise agreed in writing.
9.2 Termination by the Company
We reserve the right to suspend or terminate any account that breaches these Terms, provides fraudulent information, or brings the platform into disrepute.
9.3 Suspension/Termination at Our Discretion
We may suspend, restrict, or terminate your account (and/or access to any part of the platform) at our absolute discretion, with or without notice, for any reason (including where we believe it is necessary to protect the platform, other members, or our business).
10. Cooling-Off Period (Consumers Only)
If you are an individual acting for purposes wholly or mainly outside your trade, business, craft or profession (a “Consumer”) and you sign up online or at a distance, you have the right to cancel your Premium Membership within 14 days of the date you sign up (the “Cooling-Off Period”) without giving any reason.
If you ask us to start providing Premium features during the Cooling-Off Period, you acknowledge that you may have to pay for the services provided up to the date you cancel. If you do not ask us to start providing Premium features during the Cooling-Off Period, and you cancel within the Cooling-Off Period, you will be entitled to a refund of any amounts paid for Premium Membership.
To exercise your right to cancel, you must send us a clear statement (e.g. by email) that you wish to cancel within the Cooling-Off Period.
11. No Employment Relationship
The Construction Bible is a listing platform only. We are not an employment agency or employment business, and we do not introduce workers to hirers in a way that creates an agency relationship. Nothing in these Terms or your use of the platform creates an employer/employee relationship, worker relationship, partnership, joint venture, agency, or franchise relationship between you and us, or between any members. Any working relationship, engagement, or contract is strictly between the members involved.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
